If you were convicted of a “crime of violence” as defined by Louisiana Revised Statutes section 14:2(B) or an attempt to commit such crime, then your charge is NOT eligible for expungement, except for the following charges:
- aggravated battery
- second degree battery
- aggravated criminal damage to property
- simple robbery
- purse snatching
Convictions for the charges listed above MAY be expunged at the discretion of the judge in cases where 1) it has been at least ten years since you completed your sentence, 2) you have had no other convictions in the past ten years, and 3) you have no open charges. In such cases, it is up to the judge whether they will grant your expungement or not. If you want to request an expungement for one of the above charges, you should gather evidence of your rehabilitation to submit at the hearing, including recent employment history; technical training, college courses or self-improvement classes completed in prison or after; letters of support from employers, religious or communty leaders, etc.
